Terms of Service

Overview

This platform is operated by Exprivé, Inc. ("Exprivé", "we", "us", or "our"), a company registered in South Korea (Business Registration No. 284-88-01814). Throughout these Terms, "we", "us" and "our" refer to Exprivé, Inc.

Exprivé operates exprive.com (the "Platform"), a multi-functional digital ecosystem for foreign and expatriate users in Korea and broader Asian markets. Our services include:

  • Influencer Marketing & Collaborations: A marketplace connecting content creators with brands for social media promotions and marketing campaigns.
  • Medical & Wellness Directory: A search and discovery platform for licensed medical clinics, providing service details and appointment booking facilitation.
  • Medical, Health & Beauty Career Portal: In partnership with Wanted Labs, Exprivé provides a curated selection of job opportunities specifically targeted at the foreign community in South Korea.

These Terms govern your access to and use of the Platform, including all features, content, tools and services available through it.

By creating an account or using the Platform, you agree to these Terms. If you do not agree, you may not access or use the Platform. These Terms apply to all users including creators, brands, brand managers, location managers, and visitors.

The Platform includes, but is not limited to: the Collabs browse page, the Feed, brand portal, creator profiles, campaign management tools, messaging features, Exprivé Now travel date listings, in-platform payments (where available), and any future features we may add.

Section 1 — Definitions

The following terms have specific meanings throughout these Terms:

  • "Platform" means the Exprivé website (exprive.com) and all associated features, tools, and services.
  • "Creator" or "Influencer" means an individual who registers on the Platform to apply for and participate in Collabs.
  • "Brand" (or "Partner") refers to any business, licensed medical institution, employer, or individual that registers on the Platform to create, manage, and fund Collaborations, medical service listings, or employment opportunities.
  • "Listing" means any opportunity, campaign, course, service, or position posted by a Partner on the Platform — including but not limited to influencer collaborations (Collabs), medical appointments, academy courses, and career openings. Each Listing defines its own specific requirements, deliverables, and conditions at the point of application.
  • "Collab" means a campaign, collaboration, or promotional project created by a Brand and fulfilled by one or more Creator or User.
  • "User" means any individual who creates an account on the Platform, regardless of the features they access or the type of Listing they apply to. All Users are subject to the same Terms regardless of the vertical they engage with.
  • "Brand Portal" means the dedicated site accessible to approved Brand accounts for managing campaigns, reviewing applicants, tracking performance, and processing payments or managing credits for services acquired through the Platform.
  • "Feed" means the community activity stream where Users can post, comment on, and react to structured content.
  • "Exprivé Now" means the feature by which Creators can publish upcoming travel dates to be discovered by Brands.
  • "Content" means any text, images, videos, links, or other material submitted, posted, or transmitted by Users through the Platform.
  • "Ops" or "Exprivé Team" means Exprivé's internal operations team responsible for campaign management, shortlisting, and support.

Section 2 — Eligibility and account registration

To use the Platform you must: (a) be at least 18 years old; (b) be a natural person, legal entity, or organisation; (c) provide accurate, current, and complete registration information; and (d) comply with these Terms and all applicable laws.

Creators must use their genuine personal account. Brands must register as a business entity. Talent managers or agencies representing creators must declare this relationship on their profile. Using a brand account to access creator features — or vice versa — is prohibited and may result in account suspension.

Brand accounts are reviewed by the Exprivé team. By requesting access, you represent that you are authorised to enter into agreements on behalf of the brand you register. Exprivé reserves the right to decline any brand registration at its sole discretion.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify Exprivé immediately at [email protected] if you believe your account has been compromised.

Section 3 — General conditions

We reserve the right to refuse service to anyone for any reason at any time.

You agree not to reproduce, duplicate, copy, sell, resell, scrape, or exploit any portion of the Platform, its content, or its user data, without express written permission from Exprivé.

You agree not to use automated tools, bots, scrapers, or scripts to access, collect data from, or interact with the Platform without prior written authorisation from Exprivé.

You agree not to attempt to reverse engineer, decompile, or extract the source code of any part of the Platform.

Section 4 — Platform features and service availability  [NEW SECTION]

4.1 Collabs. The Platform facilitates connections between Brands and Creators for influencer marketing Collabs. Exprivé does not guarantee that any Creator will be selected for a Collab, or that any Collab will achieve a particular result. Campaign success depends on Creators fulfilling their obligations and Brands providing accurate and complete campaign information.

4.2 Listings. The Platform facilitates connections between Partners and Users across multiple verticals through Listings. Exprivé acts as an intermediary in all cases and does not guarantee that any User will be selected for a Listing, or that any Listing will achieve a particular result. Outcomes depend on Users fulfilling their obligations and Partners providing accurate and complete Listing information.

4.3 Brand Portal. Approved Brands may access the Brand Portal to create Collab briefs, review applicants lists, confirm selections, manage shipping and appointment details, and view performance reports. Access to the Brand Portal is subject to the active status of a Brand Account and the specific Service Tier or Pay-As-You-Go model associated with the Brand's acquired services.

4.4 Feed. Users may post on the community Feed subject to our Community Standards, which are agreed before posting for the first time. Exprivé reserves the right to remove any post at any time without prior notice. Users who repeatedly violate Community Standards may have their posting access restricted or permanently removed.

4.5 Exprivé Now. Creators may publish upcoming travel dates to their profile. This information becomes discoverable to Brands and Users on the Platform. By publishing travel dates, Creators consent to this information being displayed on the Exprive Site.

4.6 Creator profiles. Creator profile data including follower counts, audience nationality data, engagement rates, past submissions, and reliability scores may be made available to Brand accounts. Creators are responsible for ensuring their profile data is accurate. Misrepresentation of follower counts, engagement rates, or audience data is a material breach of these Terms.

4.7 Service availability. We do not guarantee that the Platform will be available at all times. We may temporarily suspend access for maintenance, updates, or unforeseen technical issues. We will endeavour to provide advance notice of planned maintenance where reasonably possible.

Section 5 — User content and intellectual property

5.1 Your content. You retain ownership of all Content you post or submit through the Platform. By submitting Content, you grant Exprivé a non-exclusive, worldwide, royalty-free, sublicensable licence to use, reproduce, distribute, display, and process your Content solely for the purposes of operating, improving, and promoting the Platform and facilitating Collabs.

5.2 Listing submissions. When you complete a Listing and submit the required deliverables, you additionally grant the relevant Partner the rights specified within that Listing at the time of Application. Exprivé is not responsible for Partner misuse of Content beyond the agreed rights.

5.3 Content standards. All Content must comply with our Community Standards. You represent that you own or have the necessary licences to submit any Content you post, and that your Content does not infringe any third-party rights.

5.4 Platform content. All Platform features, designs, logos, text, and data (other than User Content) are owned by or licensed to Exprivé. Nothing in these Terms transfers ownership of Platform content to you.

5.5 Medical content. If you post Content relating to medical procedures, treatments, or health outcomes — including before and after comparisons — you are solely responsible for ensuring compliance with Korean medical advertising law (의료법 제56조) and any other applicable regulations.

Section 6 — Prohibited uses

In addition to other prohibitions set out in these Terms, the following uses are prohibited:

  • Any unlawful purpose or activity under the laws of South Korea or your jurisdiction.
  • Infringing upon the intellectual property rights of Exprivé or any third party.
  • Harassing, abusing, threatening, intimidating, or discriminating against any user based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability.
  • Submitting false, misleading, or fraudulent information including misrepresenting your follower count, identity, or business status.
  • Uploading viruses, malware, or any code intended to disrupt, damage, or gain unauthorised access to the Platform or any connected system.
  • Using bots, scrapers, or automated tools to collect data, send messages, or interact with the Platform.
  • Recruiting or directing Platform users to competitor platforms, agencies, or services.
  • Posting affiliate links, referral codes, or unsolicited commercial promotions.
  • Posting external links designed to redirect users off the Platform for commercial benefit.
  • Attempting to execute a Collab outside the Platform to circumvent Exprivé fees or processes.
  • Impersonating another user, brand, creator, or Exprivé staff member.
  • Using a brand account to access creator features or vice versa.
  • Posting the same or substantially similar content repeatedly within a 7-day period.
  • Sharing another user's personal data (phone number, email, address) without their consent — this constitutes a violation of the Korean Personal Information Protection Act (PIPA) and GDPR where applicable.

Section 7 — Brands and campaign management  [NEW SECTION]

7.1 Listing accuracy. Partners are responsible for providing accurate, complete, and legally compliant Listings. This includes campaign briefs, course descriptions, clinic service details, and job postings. Partners must fulfil all agreed rewards, compensation, or deliverables described in the Listing and must respond to User and Exprivé communications in a timely manner.

7.2 Listing approval. Before a Listing goes live on the Platform, it must receive final approval from the registered Partner account. By approving a Listing, the Partner confirms that all information is accurate and that they accept responsibility for the Listing’s compliance with applicable law, including Korean advertising regulations and medical advertising law where applicable.

7.3 Ops-assisted campaigns. Exprivé's operations team may assist in structuring campaign briefs, shortlisting Creators, and managing coordination. This service is provided as a professional facilitation service. Exprivé does not guarantee campaign outcomes and is not liable for Creator performance or post quality.

7.4 Self-serve listings. Brands  may create and manage campaigns directly through the Brand Portal without ops assistance. Exprivé is not responsible for the content, legality, or outcome of self-managed campaigns.

7.5 Shortlisting. For ops-assisted campaigns, Brands may receive a curated shortlist of Creators prepared by the Exprivé team. Brands will not be given access to the full Creator database. Access to Creator profile data is limited to the applicants of the specific brand campaign.

7.6 Multi-branch accounts. Brands with multiple physical locations may register branches under a single parent account. Each branch is a sub-entity of the Brand account. The main account owner is responsible for all activity across all branches.

Section 8 — Creator obligations  [NEW SECTION]

8.1 Profile accuracy. Creators must maintain an accurate profile including genuine social media handles, authentic follower counts, and correct audience data. Inflating follower counts or engagement metrics is a material breach of these Terms and may result in permanent account suspension and removal from all active Collabs.

8.2 Listing commitments. Once selected for a Listing and having accepted the selection, Users are obligated to fulfil all requirements as specified within that Listing. For Collabs specifically, this includes: (a) completing the required content by the agreed submission deadline; (b) publishing content that meets the requirements set out in the Collab brief; (c) tagging all required accounts and using all required hashtags; (d) keeping published content live for the duration specified; (e) submitting the post link via My Collabs within the deadline; and (f) providing clean original video files if specified.

8.3 Disclosure. Creators must disclose sponsored content in accordance with Korean Fair Trade Commission guidelines and any applicable international standards (e.g. FTC in the United States). Posts must include #ad or equivalent where required. Exprivé is not liable for Creator failure to comply with disclosure requirements.

8.4 Reliability scoring. Exprivé's operations team may assign internal reliability and quality scores to Creator accounts based on their performance history. These scores affect Creator visibility to Brands and placement in search results. Scores are not shared directly with Creators but may be appealed through Exprivé support.

8.5 Exprivé Now. Creators who publish travel dates acknowledge that this information will be visible to Brand accounts. Publishing travel dates does not guarantee any Collab offers.

8.6 Content Deadlines & Reimbursement. Creators are strictly required to upload all agreed-upon content within the designated deadline (standardly 7-10 days post-visit unless otherwise specified). Failure to meet this deadline without prior written approval from Exprivé may result in the Creator being held liable for the full retail cost of the products or services received. Exprivé reserves the right to issue an invoice for reimbursement of these costs.

8.7 Offline Activities & Appointment Policy. For "In-Person" activities (such as Medical, Wellness, or Dining appointments), specific logistical arrangements are made by the Brand.

  • Late Cancellations & No-Shows: Cancellations made within 48 hours of the appointment, or failure to attend the appointment ("No-Show"), may result in a penalty fee or the suspension of the Creator’s account.
  • Pre-Payment & Deposit Policy: For certain high-demand appointments, Exprivé or the Brand may require the Creator to pre-pay a deposit or the full service fee. This amount will be fully reimbursed to the Creator upon successful attendance and completion of the visit.

8.8 Professional Conduct. Confirmed appointments are considered a professional commitment. Persistent failures to post content or attend appointments will result in permanent restriction from the Platform.

8.9 Communications Consent. As part of the Collab application process, Creators are asked to confirm their consent to receive campaign-related communications from Exprivé via email and direct message on social media platforms. This consent is a condition of application and participation. Creators may withdraw consent for non-operational communications at any time by contacting [email protected], subject to the terms of Section 12.1.

Section 9 — Service-Based Access and Fees  [NEW SECTION]

9.1 Access Model. Exprivé operates on a pay-per-service basis. Access to the Brand Portal and its specific features—such as campaign creation, applicant management, and reports—is granted upon the successful purchase of a Service Package.

9.2 Service Fees. Each marketing campaign is subject to a one-time service fee and, where applicable, a variable per-submission fee as outlined at the time of purchase. Exprivé reserves the right to modify pricing for future services at any time. All fees are quoted in the local currency (KRW) or USD as specified in the relevant quote. Other listings or specialized postings on the Platform are subject to one-time or monthly billing cycles, as specified and agreed upon at the point of purchase or within the individual Service Agreement.

9.3 Billing and Authorization. By acquiring a service, you authorize Exprivé (or our third-party payment processor) to charge your selected payment method for the full amount of the service fee. Access to campaign tools and applicant data is activated immediately upon successful payment verification.

9.4 Cancellation and Refunds. Once a service (such as a campaign launch or a medical posting) has been activated and the Brand has gained access to the relevant data, fees are generally non-refundable. Any requests for refunds or adjustments will be handled on a case-by-case basis and in accordance with the Korean Consumer Protection Law (전자상거래 등에서의 소비자보호에 관한 법률).

9.5 Account Maintenance. While there is no fee to maintain an "Inactive" Brand account, Exprivé reserves the right to archive accounts that have had no payment activity for more than 12 months. Archived accounts can be reactivated by contacting the Exprivé Team.

Section 10 — In-platform payments  [NEW SECTION]

10.1 Payment processing. Brands may process payments to Creators directly through the Platform. Exprivé acts as an intermediary payment facilitator and is not a financial institution or regulated payment service provider.

10.2 Platform fee. Exprivé charges a service fee on all transactions processed through the Platform. The specific fee rate is determined and agreed upon at the time of service acquisition. These fees are non-refundable, except in the event of a verified billing error or as required under Korean Consumer Protection Law. All fees are exclusive of applicable taxes unless stated otherwise.

10.3 Escrow. Where available, in-platform payments are held in escrow until the Brand or the Platform confirms post submission deadlines and guidelines were followed. Once released, payments are processed to the Creator's registered payment method. Exprivé is not responsible for delays caused by payment processors, bank procedures, or incorrect banking details provided by the Creator.

10.4 Disputes. Payment disputes between Brands and Creators must be submitted to Exprivé support within 14 days of the relevant post submission date. Exprivé will review disputes in good faith but cannot guarantee recovery of funds already disbursed.

10.5 Tax. Creators are solely responsible for declaring and paying any taxes applicable to payments received through the Platform in their jurisdiction. Exprivé may provide payment summaries for accounting purposes but does not provide tax advice.

Section 11 — Community feed and posting  [NEW SECTION]

11.1 Community Standards. Use of the Feed is subject to Exprivé's Community Standards. Prior to their first submission or post, users are required to review and formally acknowledge these Standards. Access to the Feed is contingent upon this agreement. By completing the acknowledgement and subsequently posting, you confirm your ongoing compliance with the Standards.

11.2 Post types. Users may only post content relevant to the platform and its main objective. Off-topic or prohibited posts will be removed.

11.3 External links. Clickable external URLs are not permitted in Feed post body text. Only system-generated internal Exprivé links (e.g. Collab page links, submission links) are activated. This restriction is a technical and policy measure to protect Users from spam and harmful redirects.

11.4 Moderation. Exprivé reserves the right to remove any post, comment, or reaction at any time without prior notice. Repeated violations of Community Standards will result in escalating restrictions on posting access up to and including permanent removal, as described in the Community Standards enforcement policy.

11.5 Medical content. Posts categorised as "Medical Promo" must comply with Korean medical advertising law (의료법 제56조). Brands and clinics are solely responsible for the legal compliance of medical promotional content they post on the Feed.

Section 12 — Personal information and privacy

Your personal information is governed by our Privacy Policy, available at exprive.com/privacypolicy. By using the Platform, you acknowledge and consent to the collection, use, and sharing of your personal information as described in the Privacy Policy.

User profile data — including name, social media handles, follower counts, audience data, and past submission history — may be shared with Partner accounts in connection with Listings the User has applied to. Sensitive personal information (full legal name, date of birth, phone number) collected for appointment scheduling is only visible to the Partner managing the relevant Listing. User email addresses and contact details may be shared with the relevant Partner where necessary for the execution of a confirmed Listing — for example, to coordinate appointments, shipping, or content delivery. Communication with Users may be handled by Exprivé, by the Partner, or jointly, depending on the coordination model agreed for that Listing. Users acknowledge that by accepting a Listing, their contact details may be passed to the Partner managing it, solely for the purpose of fulfilling that Listing. Partners are prohibited from using User contact details for any purpose beyond the scope of the confirmed Listing.

By using the Platform from within the European Economic Area or the United Kingdom, you have rights under the General Data Protection Regulation (GDPR). By using the Platform from within South Korea, you have rights under the Personal Information Protection Act (PIPA). These rights are described in detail in our Privacy Policy.

12.1 Communications and Messaging. By creating an account and using the Platform, you consent to receiving operational communications from Exprivé through the following channels:

(a) Email — transactional and campaign-related emails sent via Exprivé's managed email system, including application updates, collab status changes, content submission reminders, and payment notifications.

(b) Platform notifications — in-app and push notifications where you have enabled this on your device or browser.

(c) Direct messages via social media platforms — Exprivé may contact Creators via Instagram or other social media platforms for campaign coordination, scheduling, and operational matters directly related to active or pending Collabs.

(d) Automated responses — Exprivé may use automated messaging tools to respond to inbound inquiries received via social media DMs or other channels. These automated responses are operational in nature and are processed by third-party tools operating on Exprivé's behalf. By messaging Exprivé through any channel, you consent to receiving automated responses.

You may opt out of non-essential communications at any time by contacting [email protected]. Opting out of operational communications (such as collab status updates or payment notifications) may affect your ability to participate in active Collabs.

Section 13 — Accuracy of information

Exprivé does not guarantee that information on the Platform — including Creator profile data, campaign details, or performance metrics — is accurate, complete, or current at all times. Users should verify critical information independently.

Post metrics displayed in campaign reports reflect data collected at the time of report generation and may not reflect current performance. This limitation is disclosed to Brand accounts at the time of report delivery.

Report data is collected at the time of report generation (a single API call) and is not updated retroactively. This is disclosed to Brand users within the report interface.

Section 14 — Third-party services

The Platform may integrate with or link to third-party services including social media platforms (Instagram, TikTok, YouTube, Xiaohongshu), mapping services (Kakao Maps), payment processors, and delivery tracking services. Exprivé is not responsible for the accuracy, availability, or terms of third-party services. Use of third-party services is subject to the applicable third-party terms.

Exprivé may use third-party AI services to assist with campaign brief structuring and content generation features. AI-generated content suggestions are provided as assistance only and are not guaranteed to be accurate, complete, or legally compliant. Users are responsible for reviewing and approving all AI-assisted content before publication.

Exprivé may use third-party messaging automation tools (including but not limited to Meta-approved partners) to manage and respond to inbound communications received via social media platforms. These tools process message content solely for the purpose of routing and responding to your inquiry. Use of such tools is subject to the relevant third-party privacy policies, which are available upon request.

Section 15 — Disclaimer of warranties and limitation of liability

The Platform is provided "as is" and "as available" without any warranties, express or implied. Exprivé does not warrant that the Platform will be uninterrupted, error-free, or secure, or that any particular Collab will be successfully completed.

To the maximum extent permitted by applicable law, Exprivé's total liability to you for any claim arising from or related to these Terms or the Platform shall not exceed the amount you paid to Exprivé in the 12 months preceding the claim.

Exprivé is not liable for: (a) Collab outcomes or Creator performance; (b) Brand failure to fulfil agreed rewards; (c) loss of data; (d) indirect, incidental, or consequential damages; or (e) any actions taken by Users in violation of these Terms or Community Standards.

Section 16 — Indemnification

You agree to indemnify, defend, and hold harmless Exprivé, Inc. and its officers, directors, employees, and agents from any claim, demand, or damage, including reasonable legal fees, arising from: (a) your use of the Platform; (b) your breach of these Terms; (c) your violation of any third-party rights; or (d) Content you submit to the Platform.

Section 17 — Termination and suspension

These Terms are effective from the date you create an account or first use the Platform and continue until terminated.

You may terminate your account at any time by contacting [email protected]. Termination does not entitle you to a refund of any unused Subscription fees or Credits, except as required by applicable law.

Exprivé may suspend or terminate your account at any time if you breach these Terms, violate Community Standards, engage in fraudulent behaviour, or for any other reason at our sole discretion. We will endeavour to provide notice where reasonably possible, except where immediate action is required to protect the Platform or its Users.

Creators with active Collab commitments at the time of account termination remain obligated to fulfil those commitments unless their termination was caused by a Brand breach.

Section 18 — Governing law and disputes

These Terms are governed by and construed in accordance with the laws of the Republic of South Korea, without regard to conflict of law principles.

Any dispute arising from or related to these Terms or your use of the Platform shall first be submitted to Exprivé's support team for resolution. If the dispute cannot be resolved informally within 30 days, it shall be submitted to the exclusive jurisdiction of the courts of Seoul, South Korea.

For Users located in the European Economic Area, nothing in these Terms affects your rights under applicable consumer protection laws.

Section 19 — Changes to these Terms

We reserve the right to update these Terms at any time. We will post the updated Terms on this page and update the "Last Updated" date. For material changes affecting your rights, we will provide at least 14 days' notice by email before the changes take effect.

Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Terms.
